Terms of Service

These Terms of Service ("Terms") govern your use of Flamelingo, an AI-powered language tutoring service ("Flamelingo", "we", "us"). By using Flamelingo you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility and age

You must be at least 18 years old to use Flamelingo, or at least 13 years old with the verified consent and supervision of a parent or legal guardian. We do not knowingly collect personal information from children under 13 (see our Privacy Policy and the COPPA note below). Future video features will require identity and age verification for every participant, with no exceptions.

COPPA note: Flamelingo is not directed at children under 13. If we learn that a user under 13 has provided personal information without verifiable parental consent, we will delete that information and close the account. Parents can contact us at any time to review or delete a child's data.

2. The service and beta status

Flamelingo is currently a free beta. That means:

The service is provided free of charge during the beta period.
Features may be added, changed, or removed at any time without notice.
We may introduce paid plans after the beta ends. Beta usage does not entitle you to free access later.
Availability is not guaranteed and downtime can happen.

3. AI-generated content disclaimer

Lessons, corrections, translations, and explanations are generated by an AI model. The tutor may make mistakes, including incorrect grammar explanations, wrong translations, outdated cultural information, or invented facts. Flamelingo is a learning aid, not a certified instructor, translator, or source of professional advice. Always verify anything important with a qualified human. We make no guarantee of fluency, exam results, or any specific learning outcome.

4. Your account and data

A learner identifier is stored in a browser cookie so your progress persists between sessions. You are responsible for the device and browser you use. If you share a device, others may see your learning profile.

5. Your content and license

You may submit text, and in future features, images, audio, or video ("User Content"). You keep ownership of your User Content. You grant Flamelingo a worldwide, non-exclusive, royalty-free license to host, store, process, display, and transmit your User Content solely to operate, moderate, secure, and improve the service. This license ends when you delete your content or account, except for copies we must keep for legal, safety, or moderation purposes.

6. Prohibited conduct

You agree not to:

Post, send, or display nudity or sexual content, or direct sexual content at any user.
Harass, threaten, stalk, bully, or intimidate anyone.
Post hate speech or content that attacks people based on race, ethnicity, religion, sex, gender identity, sexual orientation, disability, or national origin.
Record, screenshot, or redistribute other users' sessions, likeness, or personal data without their explicit consent.
Misrepresent your age or identity, or help a minor bypass age or identity checks.
Upload malware, spam, scams, or content that infringes someone else's intellectual property.
Scrape, reverse engineer, overload, or probe the service, or resell access to it.
Use the service for anything illegal in your jurisdiction.

We may remove content, suspend, or permanently ban any account that violates these rules, with or without notice. See our Community Safety page for how reporting and enforcement work.

7. Identity verification for video features

Planned video practice features will require identity verification (KYC), including a government-issued ID and a selfie, before access is granted. Verification exists to keep minors out of video rooms and to make moderation enforceable. Submitting false documents is a violation of these Terms and may be reported to authorities where required by law.

8. Copyright and DMCA

We respect intellectual property rights. If you believe content on Flamelingo infringes your copyright, send a notice with (a) identification of the work, (b) the location of the infringing material, (c) your contact details, (d) a good-faith statement, and (e) your signature to our designated agent: DMCA Agent, Flamelingo, email: legal@flamelingo.com (placeholder address during beta). We will respond to valid notices, remove infringing material, and terminate repeat infringers.

9. Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Flamelingo and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits. Our total aggregate liability for all claims relating to the service is capped at the greater of (a) the amount you paid us in the 12 months before the claim or (b) 50 USD. Since the beta is free, that cap is 50 USD for beta users. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnity

You agree to indemnify and hold harmless Flamelingo and its operators from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of the service, or your violation of these Terms or of any law or third-party right.

12. Dispute resolution and arbitration

Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for 30 days. Any dispute that cannot be resolved informally will be settled by binding individual arbitration, except that either party may bring qualifying claims in small-claims court and either party may seek injunctive relief for intellectual property or unauthorized access claims. You waive the right to participate in class actions to the extent permitted by applicable law. If you are a consumer in a jurisdiction that does not permit mandatory arbitration or class waivers, those provisions do not apply to you and your statutory rights remain unaffected.

13. Termination

You may stop using Flamelingo at any time and may request deletion of your data. We may suspend or terminate your access at any time for violation of these Terms, for legal or safety reasons, or if we discontinue the service. Sections that by their nature should survive termination (licenses needed for moderation records, disclaimers, liability limits, indemnity, dispute resolution) survive.

14. Changes to these Terms

We may update these Terms. Material changes will be announced in the app or on this page with a new "Last updated" date. Continued use after changes take effect means you accept them.
